Acceptance of these Terms

These Terms of Service (“Terms”) govern your use of Enchamber, a secure content sharing platform operated from India. By creating an account, uploading content, or accessing a share, you agree to these Terms and to our Privacy Policy. If you do not agree to these Terms, please do not use the service.

Eligibility

You must be at least 18 years of age to use Enchamber. By creating an account you confirm that you meet this requirement and that you have the legal capacity to enter into these Terms. If you are using Enchamber on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.

Your account

You are responsible for maintaining the confidentiality of your account password and for all activity that occurs under your account. Choose a strong, unique password and do not share it. Notify us promptly at hello@enchamber.com if you believe your account has been accessed without authorisation.

You may not create an account using another person’s identity or allow another person to use your account for activity that violates these Terms.

Your content

You retain all rights to the files, text, and other content you upload to Enchamber (“Your Content”). We do not claim ownership of Your Content.

You warrant that you own Your Content, or that you have all necessary rights, licences, and permissions to upload and share it through Enchamber. You are solely responsible for Your Content and for the consequences of sharing it.

You grant us a limited, worldwide, royalty-free licence to store, transmit, display, and process Your Content for the sole purpose of operating the service (for example: storing it on our sub-processors’ infrastructure, serving it to recipients who enter the correct password, and showing you analytics about your own shares). This licence ends when you delete the share or your account.

Acceptable use and prohibited content

You agree not to upload, share, host, transmit, or link to any content that:

  • is defamatory, obscene, pornographic, or paedophilic;
  • depicts, enables, or promotes child sexual abuse in any form;
  • invades another person’s privacy or bodily privacy;
  • harasses, threatens, stalks, or intimidates any person;
  • insults, demeans, or incites hatred on grounds of religion, race, caste, creed, sex, gender, sexual orientation, place of birth, or any other protected ground;
  • threatens the unity, integrity, defence, security, or sovereignty of India, or friendly relations with any foreign state;
  • incites terrorism, extremism, or violence;
  • contains or distributes malware, viruses, worms, Trojan horses, or any other malicious code;
  • infringes any third party’s intellectual property rights, including copyrights, trademarks, patents, or trade secrets;
  • deceives or misleads recipients about the origin of a message, including phishing, impersonation, or spoofing;
  • is false, misleading, or knowingly spreads misinformation intended to cause harm;
  • violates any law in force in India.

You also agree not to: attempt to access any account or data that is not yours; probe, scan, or test the vulnerability of our systems without our written permission; interfere with the service; attempt to circumvent rate limits, storage limits, or access controls; or use automated means to create accounts or shares at scale.

Zero tolerance for CSAM

Enchamber has zero tolerance for Child Sexual Abuse Material (CSAM). If we become aware of CSAM on the platform, whether by user report or our own detection, we will: disable access to the content immediately, preserve the content and access logs for law enforcement, and report the matter to the National Cybercrime Reporting Portal (cybercrime.gov.in) and any other authority required by law. We cooperate fully with law enforcement investigations of CSAM.

Reporting illegal content

If you believe content hosted on Enchamber is illegal or violates these Terms, please report it by email to hello@enchamber.com with the subject line “Illegal Content Report”. Include: a link to the share, a description of the issue, and your contact details.

We acknowledge valid reports within 24 hours and, where a lawful notice or court order is received, we act on it within 36 hours in accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

Law enforcement and legal requests

For law enforcement requests, court orders, or data preservation notices, email hello@enchamber.com with the subject line “Legal Request”. Requests must be on official letterhead from a recognised authority. Verified lawful requests are responded to within 72 hours, as required under the Information Technology (Intermediary Guidelines) Rules, 2021. Where a lawful data preservation order applies to an account, deletion of that account may be paused until the preservation order is lifted.

Service availability

Enchamber is provided on a best-effort basis. We do not provide an uptime service level agreement on the free tier. The service may be unavailable from time to time for maintenance, infrastructure failures, force majeure events, or other reasons outside our reasonable control. Where possible, we will give advance notice of planned maintenance.

Our role and limitation of liability

Enchamber operates as an intermediary under Section 2(1)(w) of the Information Technology Act, 2000. We host and transmit Your Content at your direction. We do not initiate, select the recipient of, or modify the content of your shares. Consistent with Section 79 of the Information Technology Act, we are not liable for user-uploaded content where we act on lawful takedown notices in accordance with these Terms.

To the maximum extent permitted by law, Enchamber and its founder, employees, and sub-processors are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the service, including loss of data, loss of revenue, or loss of goodwill, even if we have been advised of the possibility of such damages.

You agree to indemnify and hold harmless Enchamber against any claim brought by a third party arising out of Your Content or your breach of these Terms.

Termination

By you: you may delete your account at any time from Settings → Danger Zone. Deletion is immediate and permanent — see our Privacy Policy for what happens to your data.

By us:we may suspend or terminate your account if we reasonably believe you have violated these Terms, for legal or regulatory reasons, or to protect the safety of our users or the integrity of the service. Where possible, we will give you 7 days’ notice before termination so you can retrieve Your Content; where the violation is serious (for example, CSAM, malware, or an active security threat), we may terminate without prior notice.

Privacy Policy

Our collection, use, and protection of personal data is described in our Privacy Policy, which is incorporated by reference into these Terms. By using Enchamber you also agree to the Privacy Policy.

Changes to these Terms

We may update these Terms from time to time. When we make a material change, we will increment the version number shown at the top of this page and, where appropriate, notify you by email. Continued use of the service after a change takes effect constitutes acceptance of the updated Terms.

In line with the Information Technology (Intermediary Guidelines) Rules, 2021, we will also notify registered users at least once a year that these Terms and our Privacy Policy are available for review.

Governing law and contact

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Bangalore.
